Readiness planning, with commencement in view.

As reviewed on 27 October 2026, the operational duties modelled here and section 33 are scheduled for commencement 18 months from the Gazette publication of G.S.R. 843(E), calculated as 13 May 2027. The Consent Manager phase is calculated as 13 November 2026. This tool models post-commencement scenarios; it does not calculate a presently payable penalty. Check later notifications before relying on these dates.

01 / Your context

Set the scope.

Use a representative business process. No organisation name, email or personal data is needed.

Scope depends on sections 3 and 17, your role, processing and any specific exemption. An exemption may affect only some duties. Processor-only activities and Consent Manager-specific obligations need a separate review.

02 / Data Privacy Risk Score

How ready are your controls?

Answer every included question. “Not sure” highlights an evidence gap. The score measures self-reported readiness gaps, not the probability of a breach or legal non-compliance.

01 Security safeguards

Section 8(5) · Rule 6 · DPCI screening weight: 30%

Assess the safeguards and evidence you would rely on to protect personal data.

02 Breach notification readiness

Section 8(6) · Rule 7 · DPCI screening weight: 20%

A readiness gap does not establish that a breach-notification failure has occurred.

03 Children’s data

Section 9 · Rules 10 and 12 · DPCI screening weight: 15%

Applies where children’s data is processed. Check relevant exemptions and their conditions individually.

04 Significant Data Fiduciary

Section 10 · Rule 13 · DPCI screening weight: 15%

SDF status requires government notification. Size, sector or a risk score alone does not establish designation.

05 Core privacy operations

Sections 4–8 and 11–17 · applicable Rules · DPCI screening weight: 20%

The residual Schedule entry is for other provisions. Do not re-count a failure already assigned to a specific entry.

03 / Penalty estimation

Build a planning scenario.

Select categories only where you want to explore a hypothetical legally established failure after commencement. Control gaps above do not automatically become penalty selections.

Each category is included at most once. The arithmetic sum is an illustrative basket of ceilings, not a statutory overall maximum or a finding that penalties can be combined in your case.
%

Your assumption, not a statutory percentage, likelihood or regulator prediction. No percentage is preselected. The risk score does not set this value.

What can influence the Board’s decision?

Section 33(2) requires consideration of the nature, gravity and duration of the breach; the type and nature of data; repetition; gain or avoided loss; mitigation and its timeliness and effectiveness; proportionality and deterrence; and the likely impact of the penalty on the person.

Prepare evidence on these factors. This tool assigns no monetary multipliers to them. Only the Board can determine a penalty after the required inquiry and opportunity to be heard.

Not modelled: Data Principal duties under section 15 (up to ₹10,000); breach of a Board-accepted voluntary undertaking under section 32 (the ceiling applicable to the underlying breach). Other laws, compensation, business losses and repeat or distinct findings are excluded.

DPCI screening methodology v1.0
Published and reviewed: 27 October 2026

Risk score

Implemented and evidenced = 0; partly implemented = 0.5; not implemented or not sure = 1. Each domain averages its answers. The total is 100 × the weighted average of included domain gaps, rounded to a whole number.

Weights: security 30%, notification 20%, children 15%, SDF 15%, core operations 20%. Excluded domains are removed and remaining weights are normalised. Unknown applicability remains included provisionally.

Interpretation

0–24: lower reported gaps. 25–49: moderate gaps. 50–74: high gaps. 75–100: very high gaps. These are DPCI prioritisation bands, not statutory ratings or validated loss probabilities.

This short screening is not the DPCI Master Control Framework v2.1 enterprise audit. Responses are unverified and the questions do not exhaust every obligation. A zero score is not compliance assurance.

Penalty scenario

The tool includes one ceiling per selected Schedule category, subject to the scope gates. Optional planning amount = that arithmetic sum × your percentage ÷ 100.

There is no automatic discount, turnover multiplier, confidence interval or predicted fine. Legal characterisation, overlapping facts, separate findings, exemptions and the Board’s decision determine actual exposure.

Does a weak control mean I owe a penalty?

No. A self-reported readiness gap is not a finding of a statutory breach. Applicability, commencement, evidence, inquiry and the Board’s decision matter. This calculator models hypothetical post-commencement scenarios.

Does the score determine Significant Data Fiduciary status?

No. SDF status depends on government notification under section 10. This tool cannot confer, predict or replace that designation.

Why is no penalty percentage recommended?

The statutory framework does not prescribe the calculator’s percentage. Entering your own assumption can support a planning discussion, but the resulting amount is not an evidence-based prediction of enforcement.

Can I share the results with my team?

Yes. Download a text summary or use Print / save as PDF. The report includes your responses, assumptions, methodology and sources. Review the contents before sharing; DPCI does not receive a copy.
